Obtaining a Marriage License: A man and a woman desiring to
enter into a ceremonial marriage must obtain a marriage license from the
county clerk of any county of this state.
Requirements: Each person applying for a license must:
Appear together at the county clerk’s office
Provide a VALID State or Government issued picture identification for
proof of identity and age (such as a Driver’s License, Texas
Identification Card or a Passport)
Provide Social Security Number (if applicable)
Not be divorced within the last 30 days (or provide a waiver)
Not presently married to someone other than the other applicant
Not related to the other applicant:
an ancestor or descendant, by blood or adoption;
a brother or sister, of the whole or half blood or by adoption;
a parent's brother or sister of the whole or half blood or by
adoption;
a son or daughter of a brother or sister of the whole or half
blood or by adoption;
a current or former stepchild or stepparent; or
a son or daughter of a parent's brother or sister of the whole or
half blood or by adoption
Be 18 years or older to obtain a marriage license without Parental
Consent
16 – 17 years old applicants – must be accompanied by a parent /
legal guardian with valid identification and must complete a
Parent Consent Form at the time of issuance
15 years old or under – requires a Court Order
$72.00 to obtain a Marriage License, Cash or Credit Card** **Convenience
fee applies for all Credit Card Transactions
Facts to Know: The applicants must remember:
A marriage ceremony may not take place during the 72 hour period
immediately following the issuance of the marriage license
The 72 hours may be waived if:
One applicant can provide an Active Duty Military Id
The applicants request a waiver from a Judge of a District Court
or a Statutory County Court or County Judge (list of judges
provided on request by the County Clerk’s Office)
If the marriage ceremony has not been conducted before the 31st day
after the date the license is issued, the marriage license expires
The person who conducts a marriage ceremony shall return the original
license to the county clerk, once the marriage is recorded the license
will be mailed to the couple at the address indicated on the
application

Persons Authorized to Conduct Ceremony The following persons are
authorized to conduct marriage ceremonies:
Licensed or ordained Christian ministers and priests;
Jewish Rabbis;
Persons who are officers of religious organizations and who are
authorized by the organization to conduct marriage ceremonies; and
Justices of Supreme Court, Judges of the Court of Criminal Appeals,
Justices of the Courts of Appeals, Judges of the District, County, and
Probate Courts, Judges of the County Courts at Law, Courts of Domestic
Relations and Juvenile Courts, retired Justices and Judges of those
Courts, Justice of the Peace, retired Justices of the Peace, or Judges
or Magistrates of the Federal Courts of this state.
